申辦《中華人民共和國(guó)外國(guó)人就業(yè)許可證書(shū)》:
用人單位應(yīng)在外國(guó)人入境之前申辦《外國(guó)人就業(yè)許可證書(shū)》。
a. 填寫(xiě)正確的《外國(guó)人就業(yè)申請(qǐng)表》二份;
b. 經(jīng)年檢有效的營(yíng)業(yè)執(zhí)照副本、注冊(cè)證或登記證(復(fù)印件),驗(yàn)資報(bào)告(復(fù)印件),外商投資企業(yè)還需提供批準(zhǔn)證書(shū)(復(fù)印件);
c. 擬聘用外國(guó)人的申請(qǐng)書(shū)(由聘用單位出具,說(shuō)明聘用原因和理由);
d. 聘用意向書(shū)(由聘用單位出具,說(shuō)明擬聘用期限、職位和工作職責(zé))或派遣證明(屬境外單位派遣且勞動(dòng)報(bào)酬等由境外支付,以及涉外項(xiàng)目中的技術(shù)人員不與用人單位簽訂勞動(dòng)合同的,應(yīng)由境外派遣單位出具派遣證明文書(shū),應(yīng)明確該境外人員與境外單位簽訂勞動(dòng)合同,建立勞動(dòng)關(guān)系,薪資由境外支付,并注明派遣期限、派駐崗位、從事工作等內(nèi)容,境外派遣單位簽章;非外商企業(yè)批準(zhǔn)證書(shū)中所列投資方派遣的,提交第三方派遣證明及境外投資者補(bǔ)充說(shuō)明,說(shuō)明派遣方、被派遣方以及投資方之間的關(guān)系,如聘用意向書(shū)或派遣證明是外文的,需同時(shí)提供中文翻譯件,翻譯件由用人單位蓋章);
e. 外國(guó)人履歷證明(含最終學(xué)歷和完整的經(jīng)歷,須中文打印,用人單位蓋章。如履歷證明是外文的,需同時(shí)提供中文翻譯件,翻譯件由用人單位蓋章);
f. 外國(guó)人任職的相關(guān)資格證明(學(xué)歷證明、技能資格證明、由該外國(guó)人原工作單位出具從事與受聘崗位相關(guān)的工作資歷證明)(原件及正規(guī)翻譯社中文翻譯件);
g. 擬聘用的外國(guó)人健康狀況證明(原件及復(fù)印件);
h. 無(wú)犯罪記錄證明(由所在國(guó)警察局、司法部、使領(lǐng)館出具,原件及正規(guī)翻譯社中文翻譯件);
i. 擬聘用的外國(guó)人有效護(hù)照復(fù)印件;
j. 其他補(bǔ)充材料。
※注意事項(xiàng):
《外國(guó)人就業(yè)許可證書(shū)》自簽發(fā)之日起六個(gè)月有效,過(guò)期不辦有關(guān)手續(xù)的,許可證書(shū)自動(dòng)失效。
Documents needed:
Local employer should apply for the Alien Employment License before foreign employee’s entry to China.
a. Application Form for Foreigner’s Employment in China (Completely filled, two copies);
b. Photocopy of Valid Business License passed annual inspection (Duplicate). Photocopy of Company Certificate of Approval (Only for companies with foreign investment and joint venture). Photocopy of Certificate of Organization Code. Photocopy of Capital(Contribution)Verification Report;
c. Application of employer company (Printed in Chinese with company’s stamp, the main reason for the employment should be clearly stated);
d. Letter of Employment Intention (Submitted by local company, term, position and main responsibility should be included) or Dispatch Letter (Aliens are dispatched and paid by foreign company abroad. Technical experts get involved in cooperative projects and do not establish labor contract with local company. Under these circumstances, dispatch certificate which is issued by foreign company abroad with stamp should be submitted. All necessary provisions, such as position, term, responsibility, employment and payment relationship with foreign company abroad should be clearly announced in it.Additional documents should be submitted to explain the relationship between all these parties, if the foreign company abroad is not listed as an investor on Certificate of Approval. Any document above in foreign languages should be attached with Chinese version with the stamp of local company);
e. Resume (Starting from the final full-time education till now, continuous and complete. Chinese version, otherwise attached with translation with stamp of local company);
f. Qualification for employment (Certificate of education, certificate of professional skill, certificate of more than 2-years working experience in the same sphere that is issued by former employer) (Original and Chinese version translated by authorized agency);
g. Original and Photocopy of Health Certificate;
h. Non-criminal Record for the Alien Employee(Issued by Police/Justice Department or Embassy of the employee’s country) (Original and Chinese version translated by authorized agency);
i. Photocopy of valid passport;
j. Other additional document if it is required.
Attention:
Alien Employment License is valid for six months since the date of issue, and automatically goes invalid without relevant procedure when expired.
English version is for reference only; Chinese version will be decisive if there is any discrepancy.
